The Most Important Terrorism Trial Of Our Time

Judge Justin L Quackenbush of the US District Court for the Eastern District of Washington in Spokane, Washington, has opened one of the most important trials in the recent U.S. history. For the first time after September 11, two American citizens involved in interrogating Islamic terrorists have been called to answer to a judge.

The federal court in Spokane heard Bruce Jessen and James Mitchell testifying on their role in the war on terror. They are among the heroes who prevented another 9/11, but they are now in the dock being financially James Mitchellcrushed by punishing legal bills -- for having tried, legally, to save American lives.

The American Civil Liberties Union brought the lawsuit on behalf of two men who were captured and detained by the CIA and the family of a third who died of hypothermia while in custody. They allege that they were beaten, deprived of sleep, forced to endure extreme temperatures and subjected to a form of waterboarding cleared the way for the case to move to the trial phase, rejecting the psychologists’ lawyers request for summary judgement.

In overseeing the design of “torture and cruel, inhuman, and degrading treatment,” the complaint alleges, Mr. Mitchell and Mr. Jessen violated international norms and were liable for “war crimes.”

Setting up what Jeremy B. White writing for the UK’s Independent called “an extraordinary public airing of how the American government treated terrorism suspects in the years following 9/11” the federal lawsuit against the two psychologists accused of being architects of Central Intelligence Agency [CIA] interrogation methods will proceed to trial.

Why is this even going to trial?

According to our friends at the Gatestone Institute, many former CIA directors explained that the program of enhanced interrogation techniques worked extremely well:

"It led to the capture of senior al Qaeda operatives, thereby removing them from the battlefield; it led to the disruption of terrorist plots and prevented mass casualty attacks, saving American and Allied lives; it added enormously to what we knew about al Qaeda as an organization and therefore informed our approaches on how best to attack, thwart and degrade it".

The CIA claimed the demonstrable successes of the interrogation program: the raid in which Osama bin Laden was killed; the capture of José Padilla, accused of wanting to commit an attack in the United States with a dirty radiological bomb; preventing an attack on the US consulate in Karachi, Pakistan; a second wave of attacks after September 11 with a plan to hijack a plane and crash it into Library Tower in Los Angeles.

John Rizzo, a government attorney working on the issue in 2002, when George W. Bush signed the executive order in which he (correctly) argued that the Geneva Convention does not apply to terrorists, testified "No, I can't honestly sit here today and say I should have objected to that,”

And Jose Rodriguez, the former head of the CIA clandestine service, told the court what was at stake: "George Washington did not face an enemy like Al Qaeda. These are people who want to die as martyrs and see the killing of thousands of innocent men, women, and children as justifiable to promote their cause. Making a few of the worst terrorists on the planet uncomfortable for a few days during their first month of imprisonment is worth it in order to save thousands of lives".

Jessen and Mitchell are not the only psychologists now in trouble for their involvement in this program. There are also the military psychologist Morgan Banks; Stephen Behnke, a former director of the American Psychological Association's ethics office; Joseph Matarazzo, a former chairperson of the Psychologist Association, who allegedly wrote an opinion for the CIA in which the deprivation of sleep would not constitute "torture.”

The reason the lawsuit against Jessen and Mitchell is going to trial is that Judge Quackenbush is catering to the Far Left and its political agenda, not the law and certainly nor the national security interests of the United States.

As our friend Giulio Meotti, Cultural Editor for Il Foglio, put it; Islamic terrorists who were arrested and deported have become "liberal causes célèbres.” Guantanamo Bay has supposedly become "the Gulag of our time"; the psychologists who interrogated the murderer who sawed off Daniel Pearl's head have been charged with working "for money"; the "black sites" in the Polish and Lithuanian forests have been compared to Nazi concentration camps, and the U.S. jurists and officials who conducted the war on terror have been compared to the Germans hanged in Nuremberg.

As James E. Mitchell said, by prosecuting what the U.S. and the West have done in the war on terror, "we will be standing on the moral high ground, looking down into a smoking hole that used to be several city blocks.”

Our spies and officials involved in the war against Islamic terrorism, like Jessen and Mitchel, now fear not only the wrath of the jihadists, but also the witch hunt of a Western media and judicial system.

Absent the case against Bruce Jessen and James Mitchell being dismissed, the United States government should defend them with every resource available, lest the talent and expertise of other experts in other fields be unavailable when it is needed most.

Terrorist

I thought we were at war with the moslimes. These people are terrorist that were caught thankfully before they could execute another 9/11 attack and are suing the men who devised the methods necessary to get further information about this enemy.

I am constantly amazed at the roadblocks political adversaries will put up to impede those who have this job. I have watched politicians and judges who do not have a clue about the real circumstances especially listening to the moslimes who are always going to lie make judgments that are detrimental to the front line combatants and our men who defend this country. One decision pushed by politicians to armed forces I particularly find really stupid. It is the do not shoot unless they shoot first rule. Now who can claim that one?

This reminds me of that kind of stupidity. Now who is going to sue the combatants who attacked or were planning further attacks that ARE real threats? If you can find them, their money, their leaders! And this witch hunt for terrorist is being conducted in the US. This is utterly disgusting and our government should be defending these men. Sadly if this had been during the reign of Obama they would have been SOL but maybe President Trump, the DOJ, or another organization can help them.

If not, and these men are broken, we will be hard pressed to entice others of their expertise to step up. And with the moslime terrorist already in the US we will need that expertise with the continued threat that cult represents. They are the enemy within that Cicero talked about centuries ago. And so are the liberals and democrat politicians that advocate this kind of nonsense and handicap our defenses.
