Assault on America, Day 449: Arrogant Dems ignored the ‘duty to rescue’ at their own peril

If you see someone in a tight spot, is there a duty to help him or her out of it?

Law professors cover the concept in Torts class, and as I recall, the answer was “yes” if you, as the reasonable person, have the ability to assist a would-be victim in a potentially dire situation he or she cannot solve on his or her own. Wikipedia describes “Duty to Rescue Laws” thusly, “A duty to rescue is a concept in tort law that arises in a number of cases, describing a circumstance in which a party can be held liable for failing to come to the rescue of another party who could face potential injury or death without being rescued. In common law systems, it is rarely formalized in statutes which would bring the penalty of law down upon those who fail to rescue. This does not necessarily obviate a moral duty to rescue: though law is binding and carries government-authorized sanctions and awarded civil penalties, there are also separate ethical arguments for a duty to rescue even where law does not punish failure to rescue.”

There you have it; it might not be against the law to look the other way while someone lies helpless in a ditch with an obviously shattered leg and his or her cell phone visibly out of reach, but there’s a moral and ethical duty to stop what you’re doing and embark on whatever rescue a reasonable person would undertake in the situation. Ultimately it’s a question for the jury (that is, if you’re sued or brought up on charges) to decide what is “reasonable” under the circumstances, but most everyone knows it when they see it.

Are you obligated to stop and help someone on the side of the road with their hazard lights on? Probably not. But if you see someone in the process of being carjacked, you bet your bottom dollar you have a duty to at least call the police.

90’s sitcom Seinfeld devotees recall that the series finale involved just such a question. No need to go into it here (has it really been 22 years since the series ended?), but some fans loved the plot and others… hated the ending because they felt the scenario portrayed the main characters as a collection of uncaring selfish losers who didn’t give a squat about human suffering. Does it sound similar to our current times?

The “Duty to rescue” has been on a lot of people’s minds lately as the COVID-19 pandemic has successfully rendered tens of millions economically impotent in the past month. This week’s back-and-forth between Republicans and Democrats raised quite a number of ethical questions about when it’s required to put personal and political demands aside and just do everything within your power to help someone in need. It’s not unlike a doctor’s Hippocratic Oath (First, do no harm), where doing something is preferable to doing nothing, though there’s no way of knowing in advance whether the cure will be more destructive than the disease.

Needless to say, House Democrats didn’t win many friends when they stuffed their coronavirus “relief” bill with tons of unrelated special interest clutter that had nothing to do with helping financially distressed Americans get through these toughest of tough months. President Trump was more put off than most, and said so. Madison Dibble reported at The Washington Examiner, “Pelosi released her own legislation after Democrats killed the coronavirus relief package in the Senate. The House's bill includes several seemingly unrelated stipulations, including an increase in collective bargaining power for unions, canceling the debt accrued by the U.S. Postal Service, increased fuel emission standards for airlines, and tax credits for the production of alternative fuels.

“In a tweet Tuesday morning, Trump ripped Pelosi's proposal, writing, ‘This is not about the ridiculous Green New Deal. It is about putting our great workers and companies BACK TO WORK!’ He added, ‘Congress must approve the deal, without all of the nonsense, today. The longer it takes, the harder it will be to start up our economy. Our workers will be hurt!’”

Congress did approve a deal -- yesterday…apparently without the superfluous nonsense.

Was the damage already done though? Tales of aloof rulers like Pelosi fill the history books. French queen Marie Antoinette allegedly uttered “Let them eat cake!” when she was informed of the unrest among the hungry peasant masses (whether she actually said it or not is beyond the point). Legend tells us that leaders push the interests of their constituents to the side at their own peril, as the people aren’t nearly as pacified and afraid of authority as elitists might bank on when times are hard and lives are at stake. Instincts take over, and things happen.

As legendary radio commentator Paul Harvey would’ve informed us, the “rest of the story” includes Antoinette losing her head to the infamous guillotine machine (of course King Louis XVI shared his wife’s fate), the product of an out-of-touch aristocracy that was unwilling and unable to move with the tide of popular opinion. Though today’s health crises vaguely resemble revolutionary France in few respects, it’s highly doubtful Pelosi and her cohorts would be publicly paraded to the execution ground… but they very well may (should) be knocked off (at) the ballot box.

If recent gun sales statistics are any indication, Americans are as worried about civil unrest as they’ve ever been. Lines might be out of control at Costco with folks hoping to buy enough toilet paper to last awhile, but citizens are purchasing firearms by the dozen because they’re distraught over home protection -- and/or the rescission of their rights.

In a sick (wrong word choice?) sort of way one almost admires Pelosi and Schumer and their Democrat caucuses for their nervy gall in all of this. Or you could simply label their stubbornness astounding arrogance. Think about it: Democrats have serious chutzpah (or is it stupidity?) to hedge bets on their uninformed voters overlooking the naked facts and how they held up an aid package that millions upon millions desperately needed to stave off ruin for a little longer, just to score political points and push through with one swoop of the pen their bat-crap crazy agenda that they couldn’t otherwise legitimately pass in a thousand years of pleading and lying.

Street lingo would indicate they have serious “bal-s” to be so callous in disregarding the dreadful situations many Americans find themselves in through no fault of their own. If this isn’t an obvious “duty to help” case, what would qualify? Democrats proceeded under the faulty assumption desperate citizens wouldn’t notice that assistance was being held back until half of Congress agreed to change the entire economy with one must-pass piece of legislation.

Of course, Democrats have deployed similar tactics for years with Planned Parenthood subsidies, attaching riders to omnibus bills that fund all or part of the government. They guess GOPers wouldn’t dare vote down the entire package lest they be labeled uncaring and harsh, etc. “Those awful Republicans are taking food out of the mouths of children to give tax breaks to the super rich corporations, blah, blah, blah.”

But now that the shoe’s on the proverbial other foot, it’s Democrats who stalled so as to enact things like universal mail-in voting, official sanction of ballot harvesting (which they used to win several close California congressional elections in 2018), extinguish every state’s voter ID laws and create a tax credit slush fund for “green energy.” And oh yeah, bailout the postal service because it can’t compete with private for-profit enterprises like UPS and FedEx.

Ask a person on the street to rank how concerned they are about “climate change” vis-à-vis losing their jobs or homes -- or lives -- due to the coronavirus and the reality is bound to be stark. Not even the most whacked out greenie weenie in Oregon would rank the Green New Deal over financial assistance to pay for food and rent. (Or would they?) Enviro nutcases like Alexandria Ocasio-Cortez might chain themselves to bulldozers to save trees but would they really watch people lose their homes or starve because of fuel standards for airlines?

What did Democrats expect, that conservatives and Republicans would just give them everything -- or a good portion of it -- they ask for because people are suffering? That’s the cruelest form of indifference and we can only hope word got out about their little stunt. Through experience we know that we can’t trust the mainstream establishment media to report what happened.

Further, where was Grampa Joe Biden on this? Some speculate the congressional Democrats’ extreme positions and lack of foresight are badly hurting his prospects to win. As the self-appointed champion of the working class, middle class, super wealthy liberal billionaires, women, minorities, small business owners, immigrants (legal and otherwise), etc., didn’t Joe have a duty to speak up and tell his party’s “leaders” to cut out the nonsense and pass an aid package?

This isn’t a situation where a few individuals struggle because they made bad decisions. It’s not like staying behind in the projected path of a category five hurricane hovering just off shore. There’re no officials going door-to-door or posting warnings that read, “If you choose to remain in place, help may not be able to reach you for hours or days. Remain behind at your own risk.”

Perhaps a more appropriate sign for today’s voters would be, “If you choose to elect Democrats in November, help may not reach you until they’ve already destroyed your livelihoods through the Green New Deal and confiscated your guns.”

‘Ol back slappin’, pearly white tooth grinnin’, hair sniffin’, citizen cussin’ and child repellin’ Biden has started conducting his own coronavirus press briefings, but he can’t do much to change the balance in Congress now. Joseph Simonson reported at The Washington Examiner, “As Biden struggles to gain media attention during Trump's and various governor's daily press briefings, the former vice president has pivoted to having various Democratic foreign policy and healthcare experts provide responses to the Trump White House's handling of the crisis...

“On Monday, Biden began his first in a series of events livestreamed from his home in Delaware. No cable stations aired his remarks, which included calls on Trump to invoke the Defense Production Act.

“’Donald Trump is not to blame for the coronavirus. But he does bear responsibility for our response,’ he said. ‘And I, along with every American, hope he steps up and starts to get this right.’”

Those are strong words from a guy who’s rarely gotten anything right in the 2020 campaign or all throughout his career.

With Trump’s poll numbers on the rise (due to his steady leadership in the coronavirus crisis), Biden’s situation is desperate. This wasn’t supposed to happen, remember? Democrats presumed people would blame Trump for the Chinese virus outbreak and magically recognize how his racist travel ban and failure to take the crisis seriously disqualified him for another four-year term.

Instead, Trump has largely given governors from both parties whatever they’ve asked for (earning praise and even friendship (?) from Democrat Governors Newsom (California) and Cuomo (New York)) and mobilized his entire administration to address the challenges head-on. Trump is in a sweet situation when he can pretty much say “yes” to anyone’s request as long as it is reasonable and related to battling the outbreak.

Trump is handling his “duty to help” very well here. Democrats? Not so much.

There is a duty to aid citizens when circumstances place them in positions they can’t control and they’ll suffer grave harm if actions aren’t done quickly to rescue them. In most cases help is a common sense call, something Democrats are either too arrogant -- or too selfish -- to understand. Americans are watching closely.

The President will have to have a black book and remember all of this and use it as ammo to politically slaughter these irresponsible egomaniacs which we all are so tired of. Hit them hard Mr President, they deserve it!! As they have no mercy for the American people, they should be afforded none!!
