Richard Viguerie: Sotomayor Nomination is a Major Opportunity for Conservatives to Define President Obama as a Radical Liberal

MANASSAS, VA -- The following is a statement by Richard A. Viguerie, Chairman of ConservativeHQ.com, regarding President Obama’s nomination of Sonia Sotomayor to the U.S. Supreme Court:

“This is an enormous opportunity for conservatives to define President Obama as a radical liberal in a way that Republicans have so far failed to do.

“This is the first opportunity in over 40 years for conservatives to have a national debate on the role of the judiciary.  Conservatives always win ideological battles, either on the short run or the long run. 

“The primary opposition to Sonia Sotomayor will come from conservatives at the national, state, and local levels. 

“President Obama’s selection of Sonia Sotomayor to replace liberal David Souter on the Supreme Court will unite all wings of the conservative movement in a major effort to educate the American people on the U.S. Constitution and the proper role of the judiciary.”

This will be the first time in 40 years that conservatives to have a national debate on the role of the judiciary? What about when Sam Alito was nominated after serving as an apologist for the "unitary executive", and supporting signing statements? How about when John Roberts was nominated, after saying that people in Guantanamo were outside the reach of U.S. Courts? (Ahem: "The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;--to all Cases affecting Ambassadors, other public Ministers and Consuls;--to all Cases of admiralty and maritime Jurisdiction;--to Controversies to which the United States shall be a Party..."- Article III, Sec.2, U.S. Constitution). The problem is that Republicans have no credibility left. When they had all three branches, they grew government, trampled on civil liberties, and treated the Constitution like toilet paper. As a result, they lost all power at the federal level & across many states. They will not even be a bump in the road for this nominee. The only good news is that her approach to the Constitution is exactly like that of David Souter; that is to say, if she has read it, she doesn't agree with it. Certainly, she in no way feels bound or even constrained by it. In short, once she takes hert seat, nothing on the Kennedy Court will change in any substantial way.

After reading Jeffrey Toobin's New Yorker article on Chief Justice Roberts and the right-wing social engineering he has advocated as head of the Supreme Court, I welcome Judge Sotomayor's appointment. Her appointment is one small way to try and minimize the disastrous "activist" approach taken by the Rehnquist-Robertscourt to engineer a right-wing social agenda in recent years. (Of course, Scalia and/or Thomas will have to be replaced by someone moderate before the Supreme Court can return to its historic place in the mainstream of American politics.) If the Supreme Court continues to wander around in the the far-right fanatic fringe of legal thought, it will be a disaster for our nation. I pray for Judge Sotomayor's speedy confirmation and for her voice to be heard as a needed balance to the right-wing nuts now on our highest court.

What is "a right-wing social agenda" -- is it concordant with our Declaration of Independence and Constitution? President Obama has apparently defined his social agenda with this "trifecta" nominee: racist (or racialist); maybe sexist; and disrespectful of our Constitution. I see the fault line so clearly now, those for and those against the Sotomayor nomination, half on the right, and the other half on the left. A nation ideologically divided along socio/political/ethnic/cultural lines. When did we become so divided or has it always been that way? I submit it was when the democrats introduced the idea of ethnic and cultural diversity, dividing people into different social classes. Oh, but it was good they told us. We are a nation of laws, and the law should be written in a manner that represents certain people's cultural values, along the lines of socio/economic needs and opportunities. My god, we are all humans, so why the fuss over how a Supreme Court Justice interprets the meaning of the law as written in the constitution? Oh, I forgot, it's all about politics. How ignorant of me...

Oh come ON, people! The media has foisted the 'right wing social agenda' on this country - it's not even alive! A conservative wants to see a balance of power in government -which does not exist today. The more the term 'radical' is applied to EITHER party, the more divisive everything becomes. And again, the media has alot to do with that sort of approach to their reporting. Granted, there are radicals in both parties, but to my mind, it's a fringe - not the body politic in either party. We must find a way for the body politic in both parties to communicate WITHOUT the 'branding' - otherwise this nation will disintegrate. And THAT'S the scary part.' Think about it. Please. I just find it amusing that socialsit liber5al democraps want anyone that is an activist, thinks that they can legislate from the bench, that it's ok to kill an unborn baby but not a criminal given the death sentence. White men (usually conservatives, BTW) have put the economy and our political system into this worldwide depression/mess (GM and Chrysler failures, bad real estate loans, two stupidly conceived and executed wars overseas, global warming, and more) and you want to KEEP an all-white, all-male perspective in charge??? (When you have already suffered a train wreck, it is logical to find new engineers. It is a proven principle of problem-solving that the more diverse the perspectives brought to bear in solving a problem, the more likely that better solutions will result.) I welcome the diversity of views that Sotomayor represents, even if is a very small counterbalance to the Rehnquist-Roberts court's right-wing social engineering and activist decisions. (She is the equal or better of any current sitting justice's pre-Supreme Court qualifications in legal experience, talent, and skills, even if you disregard her ethnicity and gender, BTW.) It is past time to reign in the right-wing Rehnquist-Roberts court's "legislation from the bench," This right-wing "judicial activism" has been tromping on long-cherished civil and human rights for over a decade, and it is time to steer the court back towards normalcy--or at least something more like it than we have seen for 10 years... If you are really so deathly afraid of Judge Sotomayor, you must not have much faith in your own creed(s) or in the American system of jurisprudence. I feel sorry for you if that is the case. As an unabashed liberal, Christian, and a lifelong participant in local and national civic affairs, I have no such fear. It is clear to me that President Obama, who is clearly more intelligent and better -educated than his predecessor, is doing an admirable job of extricating our nation from the excremental conditions we were left in by his predecessor. (Thank God for proof that miracles do take place...)
