Oyster Farmer Leads on Property and Commerce Rights
York County VA oyster farmer Anthony Bavuso’s lawsuit against his county’s special-use permit requirement will move to the York County-Poquoson Circuit Court, after the county attempted to dismiss the case. The case questions whether the county’s zoning ordinance is in violation of the Right to Farm Act.
VA Lawmaker: ‘Downzoning’ Undercuts Property Rights
VA State Delegate Brenda Pogge says “politics, not sound commonsense” are driving an Eastern Shore county campaign to zone out agricultural activities. “Downzoning always results in a loss of property rights, and we may be looking at 5,000 to 7,000 citizens losing freedoms that they already enjoy,” Pogge said.
