Late Friday the Democrats at Biden's Department of Education withdrew their proposed rules that would have forced girls’ athletic teams to play against men by requiring participation in single-sex sports according to “gender identity.”
The Democrat-proposed rule change that would have punished schools for preventing trans athletes from competing in women's sports. The rule would have officially outlawed individual states from banning participation in single-sex sports by gender identity rather than just sex. There are 23 states in the U.S. that have legislation in place to restrict trans athletes from competing as females in public school sports.
The purported intent of Biden's proposal was to "propose a regulatory standard under Title IX that would govern a recipient’s adoption or application of sex-related criteria that would limit or deny a student’s eligibility to participate on a male or female athletic team consistent with their gender identity."
In reality it would have forced girls and women to compete against men.
Multiple Republican-governed states have filed lawsuits and enacted their own laws to address the issue after the Biden-Harris administration issued a sweeping rule that clarified that Title IX’s ban on "sex" discrimination in schools covers discrimination based on gender identity, sexual orientation and "pregnancy or related conditions."
FOX News reported that in August, The Supreme Court ruled 5-4 to deny the administration an emergency request to enforce that sweeping rule. The request would have permitted biological men in women’s bathrooms, locker rooms and dorms in 10 states where there are state-level and local-level rules in place to prevent it. Associate Justice Neil Gorsuch was the only conservative justice to dissent in that decision.
The Epoch Times reported the proposed rule generated over 150,000 public comments, ranging from outright opposition to suggestions for modifications. Additionally, ongoing lawsuits challenging the interpretation of Title IX in cases involving gender identity and sports influenced the decision to step back.
The Biden administration noted in its filing that it chose “not to regulate on this issue at this time,” citing the complexity of the comments and the unresolved legal battles.
President Trump has pledged to take stricter action, including restricting transgender procedures for minors and bolstering protections for women in sports.
However, there is still more to be done to unwind the Biden Democrats’ efforts to institutionalize gender dysphoria in our children’s schools.

The bill, sponsored in the Senate by Republican Senators Roger Marshall, Risch, Crapo, and Hyde-Smith, and in the House by Representatives by Republican Rep. Mary Miller, R-Ill, Debbie Lesko of Arizona, Lisa McClain of Michigan, Anna Paulina Luna of Florida, Lauren Boebert of Colorado, Claudia Tenney of New York, Barry Moore of Alabama, Greg Steube of Florida, Doug LaMalfa of California, Keith Self of Texas, Michael Guest of Mississippi, Andy Harris of Maryland, and Alex Mooney of West Virginia, would prevent future rulemaking that purports to redefine sex as something other than the binary biological traits of male and female.
“The Defining Male and Female Act will enshrine these definitions in federal law, preventing future departments and administrations from redefining this fundamental characteristic,” explained Rep. Mary Miller.
