Congressman Chip Roy on Monday filed articles of impeachment against U.S. District Judge Deborah Boardman, who sentenced Nicholas Roske, Supreme Court Justice Brett Kavanaugh’s attempted assassin, to only eight years in prison — significantly lower than what federal sentencing guidelines and prosecutors called for.
Original cosponsors of the Article of Impeachment, H.Res.818, include principled limited government constitutional conservative Representatives Josh Brecheen [R-OK-2], Anna Paulina Luna [R-FL-13], Clay Higgins [R-LA-3], Brian Babin [R-TX-36], and Mary E. Miller [R-IL-15].

“Instead of doing what the Judiciary calls for and sentencing this man to the base 30-year sentence recommended by the Department of Justice, Judge Boardman purposefully allowed this man off easy,” Roy said.
And Rep. Roy isn’t the only voice on the Right that sees Judge Boardman’s conduct as being worthy of impeachment.
Our friend and law professor Ilya Shapiro, writing in DC’s City Journal, observed, “Judge Deborah Boardman’s lenient sentencing of Nicholas Roske—the man who plotted to kill Supreme Court Justice Brett Kavanaugh—represents not merely poor judgment but a fundamental breach of judicial responsibility. She should be impeached.
“I don’t say this lightly—and I’ve never before called for the impeachment of a federal judge. This constitutional mechanism exists to preserve the rule of law from genuine abuses of power, not to punish decisions we disagree with. But when a judge’s conduct reveals a disregard for her constitutional duty—and actively endangers the federal judiciary individually and collectively—we must consider the remedy the Framers provided.”
Mr. Shapiro further noted, “This case reinforces the growing perception that America has a two-tiered justice system. Conservatives are prosecuted to the fullest extent of the law for political trespasses—some January 6 defendants were sentenced to more than 20 years—while left-wing violence is rationalized or excused. Had a Trump supporter armed himself to kill Justice Sonia Sotomayor, does anyone think the sentence would have been as light?
“Judicial legitimacy depends on the assurance that the law applies equally, regardless of a perpetrator’s ideology. If a conservative justice’s would-be assassin is treated as a victim rather than a criminal because his politics or gender identity align with progressive narratives, then equal protection of the law is a hollow promise. To call for impeachment here is to reaffirm that justice must be blind.”
In exclusive remarks to The Daily Wire, Rep. Roy said, “Our nation’s judicial system is structured to administer proper and equal treatment under the law; it is not a system where a member of the Judiciary is to allow their personal feelings or political ideology to influence their decision-making — oftentimes resulting in more criminals on the street.”
Roy believes the judge violated her oath of office by not administering her sentencing “impartially” and by “not upholding the ‘good behavior’ that Judges must abide by.”
“Judge Boardman should be impeached swiftly and without reservation,” Roy added.
Republican Senators Ted Cruz (Texas), Mike Lee (Utah) and Tom Cotton (Arkansas) have called for Boardman’s impeachment. Shortly after the sentence, Sen. Tom Cotton (R-AR) introduced a bill that would “Prevent judges from using perceived gender-identity as a factor when determining the length of a sentence,” and another that would prohibit housing transgender inmates with members of the opposite biological sex.
Roy noted the assassin “went to great lengths to methodically plan for the attack by spending months researching the private residence of a sitting Supreme Court Justice and obtaining countless weapons and other instruments to fulfill his plot to kill.”
Roy, a member of the House Judiciary Committee, said the judge “unequivocally based this weak sentence on the attempted assassin’s ‘gender identity,’ as the attempted assassin expressed that he views himself as a woman.”
Roske meticulously planned the assassination for months but had a change of heart outside the conservative justice’s home and called the police to turn himself in. Roske faced up to life in prison under federal sentencing guidelines. Prosecutors asked for 30 years, but instead, based entirely on his ‘gender identification,’ Judge Boardman sentenced him to just eight years.
